Zirve

Terms of Use

Version 1 · Effective and last updated: 6 November 2026 · Türkçe

These Terms of Use (the “Terms”) set out the rules between you and us when you use the Zirve mobile game and its online services (the “Game”). We have tried to keep them short and plain.

Summary

  • We give you a personal licence to play Zirve. The Game and everything in it belongs to us or our licensors.
  • Gems, lives, boosters, outfits, tower themes and other in-game items are rights to use them in the Game; they cannot be turned into real money, sold or transferred to anyone else.
  • Purchases are made through Apple; payment and refunds follow Apple's rules. Nothing sold for real money has random contents; chests can only be earned by playing.
  • Ads are shown only when you ask for one (rewarded ads); you never have to watch them.
  • Don't cheat, harass other players or use an inappropriate name. Our server verifies results; results and rewards that break the rules may not count.
  • Leagues, the daily tower, seasons and leaderboards give in-game rewards only; they are not gambling and cannot be turned into real money.
  • Your personal data is handled as described in the Privacy Policy.
  • These Terms do not take away the mandatory rights consumer law in your country gives you.

1. Parties and scope

1.1. These Terms are an agreement between you and Mehmet Mutlu (an independent developer based in Türkiye; “Zirve”, “we”; contact: destek@mm-apps.com).

1.2. When you download the Game from the App Store, Apple's standard end user licence agreement (Apple EULA) also applies. These Terms supplement the Apple EULA; the relationship with Apple is explained in Section 14.

1.3. How your personal data is processed is explained in the Privacy Policy. The Privacy Policy is information; it is not part of these Terms and you don't need to agree to it to play.

2. Acceptance

2.1. When you first open the Game, a welcome page briefly introduces it and links to these Terms and the Privacy Policy. By tapping “Kabul ediyorum, başlayalım” (“I agree, let's start”, shown in your language) you accept these Terms (version 1). The version you accepted and the time are stored only on your device; they are not sent to us.

2.2. The welcome page does not ask for any data permission. In the European Economic Area, the UK and Switzerland, Google's ad consent form and then iOS's tracking permission are asked separately and are optional (Section 8); permission for usage statistics is asked separately too. Your answers don't affect how you can play.

2.3. If you do not accept these Terms, you should not use the Game.

3. Who can play

3.1. Zirve is a puzzle game players of any age can play. If you are under 18, you should play with the permission of a parent or legal guardian, and ask them before making any purchase.

3.2. Parents can control their children's purchases with iOS “Screen Time” and “Ask to Buy”. Rules on children's data are in the Privacy Policy.

4. Licence

4.1. We grant you a non-exclusive, non-transferable, non-sublicensable licence, terminable under these Terms, to play the Game on Apple devices you own or control, for personal, non-commercial purposes. The Game and its content are licensed, not sold.

4.2. Except where mandatory law expressly allows it, you may not: copy, modify, decompile or reverse-engineer the Game or its communication with our server; access the Game or our server without authorisation; rent, sell or commercially exploit the Game; or circumvent security or anti-cheat measures.

4.3. All intellectual property rights in the Game, including its name, puzzles, characters, artwork, sounds and software, belong to us or our licensors. No rights pass to you except those expressly granted in these Terms.

5. Your account

5.1. When you first open the Game, a guest account with a random ID is created for you. We don't ask for a name, email address or password.

5.2. If you like, you can sign in with Apple under Profile → Settings → Account. Your progress, gems and purchases are then tied to your account, and you can continue on another device or after reinstalling with the same Apple account. If you play without signing in with Apple, we may not be able to restore your progress and items if you lose or reset your device or delete the app. If a guest account signs in with Apple into an account that already exists, the Game explains how progress is combined; purchased but unspent gems and purchased content move to that account.

5.3. You may not sell, rent, transfer or share your account or the items in it.

5.4. You can get a copy of your data under Profile → Settings → Account → Download my data.

5.5. You can delete your account at any time under Profile → Settings → Account → Delete account (Delete your account). Deletion cannot be undone: your progress and all items in your account (including purchased ones) are permanently deleted. Non-consumable purchases that Apple restores, such as season sets, stay with your Apple account and can be restored to a new account.

5.6. Unused guest accounts: a guest account that never signed in with Apple and never made a purchase is deleted automatically, with all its game data, after 12 months without any use (the app never connecting to our server). Because we have no contact details, we cannot warn you beforehand. This deletion does not give rise to any payment or compensation.

6. In-game items

6.1. Gems, lives, boosters (hints, extra time, streak savers), outfits, tower themes, chests, stars, season points, badges and other in-game items (“Virtual Items”) are a limited, personal, non-transferable right to use them in the Game (a licence). You do not own Virtual Items. Your mandatory consumer-law rights relating to the price you paid for purchased Virtual Items are unaffected.

6.2. Virtual Items cannot be exchanged for real money, goods or anything else of value, cannot be moved to other accounts and cannot be bought or sold outside the Game.

6.3. Gems can be earned by playing (for example from chests, the daily tower, the season track and invitations) or bought in packs from the App Store; both go into the same balance. You can use gems to refill lives, continue when time runs out, and buy boosters, outfits and tower themes. Lives refill on their own over time; you can also refill them with gems or with an optional rewarded ad. Gems do not expire.

6.4. Chests can only be earned by playing (by clearing a number of floors in the tower); they are never sold for real money or gems. Some boosters in a chest are chosen by chance, but you never pay anything to get a chest. Everything you buy with real money or gems shows its contents before you buy it and is not random.

6.5. To improve the Game we may change its balance (for example puzzle difficulty, reward amounts, or the gem prices of items). We do not arbitrarily take away Virtual Items you bought. If a change would significantly alter an item you bought to your detriment, we will announce it in the Game in advance; any rights your local law gives you in that case are unaffected.

6.6. If a Virtual Item was granted wrongly because of a bug, cheating or a system failure, we may correct it or take it back.

7. Purchases, refunds and withdrawal

7.1. You can buy with real money: gem packs; the starter pack, offered once per account for a limited time; the premium season for the current month's season; and the season set with that month's outfit and theme. The contents and price of each product are shown before you buy.

7.2. Purchases are made through the App Store, using Apple's payment system. Prices are read from the App Store and shown in your currency, including taxes; payment, billing and taxes follow Apple's rules. Your card details never reach us.

7.3. Outfits and themes are tied to your account. “Restore purchases” in the store and signing in with Apple bring back your permanent purchases (season sets and the outfit from the starter pack). Consumable items such as gems and boosters are granted once.

7.4. Refunds are requested from Apple (reportaproblem.apple.com). Apple decides on refunds; we cannot refund from within the app. If Apple refunds a purchase, we take back the Virtual Items granted with it: the refunded gems are deducted from your balance, and if the balance is not enough, the rest is deducted from gems you earn later; if a premium season is refunded, gems collected from that season's premium track are taken back too. This never creates any obligation to pay real money.

7.5. Right of withdrawal:

  • Consumers in Türkiye: under Article 15(1)(ğ) of the Distance Contracts Regulation, the right of withdrawal does not apply to services performed instantly in electronic form or intangible goods delivered instantly to the consumer. Digital content you buy is delivered to your account immediately after you confirm the purchase.
  • Consumers in the European Union and the European Economic Area: for digital content you generally have a 14-day right of withdrawal, which ends if delivery begins within the withdrawal period with your express consent and your acknowledgement that you lose the right. Because purchases are made through Apple, these steps are part of Apple's purchase process; to exercise the right of withdrawal you contact Apple.
  • Any broader refund options under Apple's own policies always remain available.

7.6. Missing or faulty purchases: if something you bought does not reach your account, first try “Restore purchases” in the store. If that doesn't help, email destek@mm-apps.com with the support code from the app (Profile → Settings → Account) and the order number from Apple's receipt; we will deliver or fix the item within a reasonable time and free of charge. Your mandatory consumer-law rights, including those for defective goods and services, are unaffected.

7.7. Purchases in test versions such as TestFlight are free in Apple's test environment and create no real rights.

8. Ads

8.1. Ads in Zirve appear only when you ask for one: when you tap “Watch ad” to get a life, continue after time runs out or double a chest's reward. No ad interrupts play, and watching ads is never required: for lives and continuing you can also wait or use gems. Ads are limited to content suitable for general audiences.

8.2. Ads are served by Google AdMob. Personalised ads are shown only if you tap “Allow” in iOS's tracking permission and (in the European Economic Area, the UK and Switzerland) consent in Google's consent form; otherwise ads are non-personalised. You can change your choice at any time in iOS Settings → Privacy & Security → Tracking and in the app's privacy options (Profile → Settings). Details: Privacy Policy → Ads.

8.3. Advertisers are responsible for the content of their ads. If you see an inappropriate ad, please tell us. An ad may not always be available; if an ad fails to load or is closed early, no ad reward is given (a chest's normal reward is always yours).

9. Fair play

9.1. To keep the Game fair and safe for everyone, you must not:

  • Cheat: modify the Game, the save on your device or requests to the server; use bots, macros, scripts or modified apps; knowingly exploit bugs for an unfair advantage; or try to fake results, rewards or rankings.
  • Abuse multiple accounts: use more than one account to manipulate league groups, leaderboards, invitation rewards or name reports.
  • Harm the service: overload or attack our server, or run security tests without permission. If you find a security issue, please report it to destek@mm-apps.com.
  • Act unlawfully in any other way.

9.2. The server verifies results. Floor results, daily tower runs, gem movements and rewards are checked on our server against its own rules (for example floor order, time and pace, and daily limits). The same floor counts at most 5 times in any 5 hours; further clears do not affect your record but give no league points or rewards. Floors played with the time assist do not count towards league and daily tower rankings; calm mode gives no rewards, league points or record. A result that cannot be verified does not count; this alone is not an accusation. If you think a result was wrongly rejected, you can write to us.

9.3. If there are reasonable grounds to believe you have broken these Terms, we may take measures proportionate to the breach: rejecting results; taking back rewards, points or Virtual Items gained unfairly; resetting your name; and, for serious or repeated breaches, closing your account. If your account is restricted or closed wrongly, we will put it right. Except where mandatory consumer law requires otherwise, no refund is given for unspent Virtual Items in an account closed for a serious breach.

10. Player names and moderation

10.1. The only user content other players see in Zirve is your display name; there is no chat, profile text or image upload. Your name appears in the league, daily tower, calm-mode weekly list, Top climbers and friends lists. Don't use your real name; choose a nickname.

10.2. Names must be 3–16 characters. Names with swearing, insults, hate speech, sexual or violent content, names impersonating someone else or us, and names containing an email address, phone number or website address are not allowed. Names are checked automatically on your device and on our server; a name that breaks the rules is not accepted. After your first name and one correction straight after, you can change your name once every 24 hours.

10.3. Long-press a player's row to report their name or block them. The reported player is not told who reported them. A blocked player disappears from your lists and any friendship ends; you can unblock under Profile → Settings → Blocked players. Reporting an acceptable name to harass someone is not allowed.

10.4. If enough trusted players report the same name within a set period, the name is reset automatically: you appear as “Climber” with a short code and can choose a new name right away, but you cannot use that name again. Reset names are reviewed by a person; we may also reset an inappropriate name manually after reviewing reports or complaints. If you think a decision is wrong, you can appeal by emailing destek@mm-apps.com with your support code; a person reviews your appeal.

10.5. If you think a name is unlawful, besides reporting it in the app you can also email destek@mm-apps.com explaining why and where the name appears.

11. Leagues, daily tower, seasons and leaderboards

11.1. The weekly league counts the floors you clear that week; at the end of the week, depending on your place in your group, you move up a tier, stay or move down. The daily tower is the same 10 floors for everyone; it gives gems and boosters depending on how far you get and uses no lives. A season lasts one calendar month; you earn points as you play and collect rewards on the free track (and the premium track if you bought it); when the season ends, rewards you reached but did not collect are granted automatically. Top climbers shows the players who have climbed highest in the tower and gives no rewards.

11.2. Their rewards are Virtual Items (Section 6): they can only be used in the Game and cannot be exchanged for real money or anything else of value. Leagues, the daily tower and leaderboards are not gambling, a prize draw or a lottery: no payment is needed to take part and nothing is drawn; rankings come only from results our server has verified. Our server's records decide rankings and rewards.

11.3. We may change the rules, rewards and schedule of these features to improve the Game; the current rules are shown in the Game. A reward gained through cheating or another breach of the rules is not granted, and may be taken back if it was.

12. Changes to the Game and to these Terms

12.1. We may update the Game and add, change or remove puzzles, features and content. Most of the tower can be played offline; leagues, the daily tower, leaderboards, friends, delivery of purchases and progress backup depend on our server.

12.2. We may update these Terms as the Game, our services or the law change. For a significant change the version number goes up and you are asked to accept the new version in the app; it takes effect for you when you accept it. If you don't accept it, you can stop using the Game and delete your account. Changes that don't alter the meaning, such as typo fixes, don't change the version. Changes do not retroactively reduce your rights in items you have already bought.

12.3. If we decide to shut down the Game's online services entirely, we will announce it in the Game reasonably in advance and stop selling for real money from that moment. Any rights consumer law gives you for unspent purchases are unaffected.

13. Availability and liability

13.1. We develop and run the Game with care, but we cannot guarantee it will work without interruption or errors. Online features may be temporarily unavailable because of maintenance, updates or causes outside our control (such as internet outages or provider failures). To the extent mandatory law allows, the Game is provided “as is”.

13.2. Our liability is not limited for damage caused intentionally or by gross negligence, for injury to life, body or health, or in other cases where mandatory law provides so.

13.3. For other damage caused by slight negligence, we are liable only if we breach an essential obligation (such as delivering content you bought), and only for the foreseeable damage typical for this kind of contract at the time it was made. If a Virtual Item you bought is lost through our fault, we will first restore it to your account.

13.4. We are not liable for loss of progress caused by losing or resetting your device or deleting the app in an account not signed in with Apple, unless we caused the loss.

13.5. Nothing in this section limits rights that consumer law in your country, including Turkish Consumer Protection Law No. 6502, gives you and that cannot be limited by contract; any limitation such law makes invalid does not apply to that extent.

13.6. Third-party services such as Apple (App Store, Sign in with Apple, Game Center) and Google (AdMob) are subject to their own terms.

14. Relationship with Apple

14.1. These Terms are between you and us, not Apple. We, not Apple, are responsible for the Game and its content.

14.2. Apple has no obligation to provide maintenance or support for the Game.

14.3. If the Game fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price where applicable. To the extent permitted by law, Apple has no other warranty obligation with respect to the Game.

14.4. Any claims relating to the Game, including product liability, regulatory compliance, consumer protection and intellectual property infringement claims, are directed to us, not Apple.

14.5. You represent that you are not located in a country subject to a US government embargo or designated as a “terrorist supporting” country, and that you are not on any US government list of prohibited or restricted parties.

14.6. You must comply with applicable third-party terms (such as your internet provider's terms) when using the Game.

14.7. Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, have the right to enforce them against you.

15. Termination

15.1. You can stop using the Game and delete your account at any time (Section 5.5). These Terms end when your account is deleted, when it is closed under Section 9.3, or when the Game's online services end.

15.2. Provisions that by their nature should survive (intellectual property, liability, governing law) continue to apply.

16. Governing law and disputes

16.1. These Terms are governed by Turkish law. If you are a consumer, the mandatory consumer-protection rules of the country where you habitually live, which cannot be excluded by contract, still apply.

16.2. Consumers in Türkiye may, under Law No. 6502, apply to the consumer arbitration committee for disputes below the monetary threshold announced each year by the Ministry of Trade, and to the consumer court above it; where the law requires, mediation must be tried before going to court.

16.3. Consumers in the European Union may bring proceedings in the courts where they live, and proceedings against them may only be brought there.

16.4. If you write to us first, we can usually solve the problem quickly.

17. Other provisions

17.1. If any provision of these Terms is held invalid, the rest remain in effect. Our not exercising a right does not mean we waive it.

17.2. These Terms were written in Turkish; this English version is a translation, and the Turkish text prevails if they differ. This does not limit mandatory rights your local law gives you.
